Social Security Disability (SSDI):
The Social Security disability program is one of the largest of several federal programs that provide assistance to people with disabilities. Individuals who have a disability and meet medical criteria may qualify for benefits under the Social Security disability program. Social Security pays benefits to people who cannot work because they have a medical condition that is expected to last at least one year or result in death. You should apply for disability benefits as soon as you become disabled. It can take a long time to process an application for disability benefits (three to five months).

The initial claim application is lengthy and detailed. It is important for the application to be filled out correctly and filed as soon as possible. Before beginning the application, you should gather all of the related documentation: Original or certified copies of personal identification,your prescription information, medical records including lab and test results, each care provider's name, phone number, and address, information regarding the type of work you performed, performed in the past and your education and work history, and W-2 forms and other employment tax records.
The initial claim can take four to six months to be processed and for a decision to be made. Level 1: Reconsideration of your initial claim: You must request a reconsideration of your claim within sixty days of receipt of the denial letter. Reconsideration is a complete review of your claim by someone who did not take part in the first decision. They will look at all the evidence submitted when the original decision was made, plus any new evidence. After approximately four to six months a decision will be reached on the reconsideration request. The case will either be granted benefits or denied again. In some states, this process may vary.
Level 2: Hearing by an administrative law judge: If your claim is denied after reconsideration, you have 60 days to request an informal hearing. This will be in front of an administrative law judge who had no part in the first decision or the reconsideration of your case. The judge will listen to witnesses, review medical evidence, and decide your case. An SSDI appeal lawyer will help you prepare for the hearing and represent you at the hearing. The Judge will not announce a decision at the administrative hearing. It usually takes at least two to three months after the hearing to receive the decision, if not longer. If the decision is favorable, you should receive your first check about eight to twelve weeks after the decision.
Level 3: Review by the Appeals Council: If the Judge's decision is not in your favor, the next step is to request a review by The Appeals Council. This must be done within sixty days after you have received the hearing decision. You should be represented by a lawyer to ensure you have the best chance of winning the appeal. A failure to appeal by the deadline will result in having to start an entirely new claim unless you can demonstrate good cause for not filing the appeal prior to the deadline. The Council looks at all requests for review, but it may deny a request if it believes the hearing decision was correct. If the Appeals Council decides to review your case, it will either decide your case itself or return it to an administrative law judge for further review. If the Appeals Council denies your request for review, you will receive a letter explaining the denial. If the Appeals Council reviews your case and makes a decision itself, you will receive a copy of the decision. If the Appeals Council returns your case to an administrative law judge, you will receive a letter and a copy of the order.
Level 4: Federal Court: If the Appeals Council denies your appeal and/or refuses to review your case, you have 60 days to file a lawsuit in a federal district court. After reviewing the record from your hearing, the Federal judge can (1) award disability benefits, (2) deny disability benefits, or (3) send your case back to a lower court for an additional hearing. SS DETERMINATIONS:The New 20 Day Quick Disability Determinations Individuals who are clearly disabled get awarded SSDI or SSI benefits without having to wait too long. The new rule aims to identity those individuals that have a high potential to receive fully favorable decisions, and expedite their process for benefits. A new Quick Disability Determination (QDD) unit will handle the claims of individuals who have certain disabilities that are easily verifiable by evidence. This new QDD unit will be comprised of DDS employees who are experienced at making these sorts of disability determinations and have the knowledge and training needed to carry out this function. Each QDD unit will be made up of experienced examiners and a medical expert. A claim will need to be signed-off as qualifying for benefits by both the examiner and expert before benefits are awarded. If an individual meets the QDD criteria for a favorable decision, meaning their disability is one that is highly likely to receive a favorable decision and is easily verifiable by evidence, then the QDD has a 20 day timeline in which to make a favorable determination of the claim. Therefore, such individuals will get favorable decisions within 20 calendar days after their claim is received by the QDD unit from the field office, rather than having to wait for the regular extended periods of time.
New Time Limits to Submit Evidence to the Judge at Hearing Level: The rule states that an administrative law judge will notify the claimant of the time and place of the hearing75 days before the date of the hearing. Claimants are now required to submit all evidence no later than 5 business days before the hearing. This will ensure the judge and all experts that will be at the hearing have sufficient time to review the records. There are limited exceptions to this 5 day limit for unusual or unavoidable circumstances. However, late evidence will only be allowed under these narrow exceptions if the evidence would affect the outcome of the case. Therefore, it is now crucial claimants submit all evidence they want considered in their case in a timely manner. The new rule also requires that claimants submit a detailed statement with their request for hearing which states why they disagree with the Federal Reviewing Official's decision and how their impairments prevent them from working. Also, a claimant may be required to prepare a pre-hearing statement, which needs to address the issues in the case, facts, witnesses, as well as evidentiary and legal basis upon which the claim can be approved. The judge may also request a mandatory pre-hearing conference, which if a claimant does not attend, can lead to dismissal of the case. Therefore, it is extremely important to be organized and punctual at the hearing stage.
Phasing out the Appeals Council and Introducing the New Decision Review Board: A new body called the Decision Review Board will be created to correct the decision errors at all levels of the Social Security Disability process. Claimants who receive unfavorable decisions will be allowed to get another review by the Decision Review Board. However, claimants will be required to submit to the Board, a statement explaining why they disagree with the administrative law judge's opinion. The old Appeals Council will be gradually phased out as this new Decision Review Board is implemented through the nation.

Social Security Disability Insurance (SSDI) is a disability insurance program financed with Social Security taxes paid by workers, employers, and self-employed persons. Q. How long does an application take & what are the steps?

Q. What are the benefits of SSDI over Long Term Disability Insurance?
Increased Monthly Income: Social Security provides a regular monthly payment that supplements any current disability benefits already received. It also provides annual cost of living increases. A portion of these benefits may be tax free.
Medical Benefits: Regardless of a person's age, after receiving SSDI benefits for 24 months, they are eligible for Medicare, including Part A (hospital benefits) and Part B (medical benefits).
Prescription Drug Coverage: Once a person is entitled to Medicare, they are also eligible for Medicare Part D, the new prescription drug plan.
COBRA Extension: If a person receives Social Security disability benefits, any COBRA benefits may also be extended from 18 to 29 months.
Protected Retirement Benefits: Social Security disability entitlement "freezes" Social Security earnings records during a person's period of disability. Because those years will not be counted when computing future benefits, their Social Security retirement benefits will be higher.
Dependent Benefits: If a person receives Social Security disability benefits and they have a dependent under age 18, he or she may also be eligible for benefits.

For all types of SSI benefits, there is a base amount that an individual with minimal income receives. The monthly payment varies up to the maximum federal benefit rate, which may be supplemented by the state or decreased by countable income and resources. Other income that an individual has reduces the amount of SSI which an individual can receive.
Q: How long does it take the Social Security Administration to make a decision?
In most cases, Social Security makes the first decision within five months after you file for disability benefits. If you are denied SSI or SSDI at the initial application stage and appeal the decision by request for a hearing, it takes an additional twelve to twenty-four months to get a final hearing decision. Q: How does Social Security determine if I am disabled?

Q: How far back will they pay benefits if I am found disabled?
Benefits will not be retroactively paid for more than one year prior to the date of an SSI, SSDI, or Disabled Widower(s) claim. Disabled Adult Child benefits will not be paid retroactively for more than six months prior to the claim. It is important to file as soon as possible to secure maximum benefits.

Q: When will I receive my first benefit check?
For SSI, SSDI, and Disabled Widow's and Widower's Benefits, the benefits cannot begin until five months have passed after the person becomes disabled. Social Security Disability for Anxiety: Including: Anxiety is either the predominant disturbance or it is experienced if the individual attempts to master symptoms.
In order to be granted Social Security Disability or SSI benefits, the anxiety must be affecting the claimant to the point that he or she would not be able to do any kind of work. Consider if there are any jobs that this person could reasonably take on without needing additional help or special treatment from the employer. Medical treatment, especially from a psychologist or psychiatrist will be almost essential to any anxiety claim for Social Security disability benefits or SSI.
When a disability claim for mental anxiety is reviewed, Social Security will want to know if there are medically documented findings showing motor tension, autonomic hyperactivity, apprehensive expectation, vigilance and scanning, persistent irrational fear of something, recurrent severe panic attacks, recurrent obsessions or compulsions, recurrent and intrusive recollections of a traumatic experience, restrictions of daily living activities, difficulties maintaining social functioning, difficulties maintaining concentrationg, pace or persistence, or complete inability to function independently outside of one's home. The more of these symptoms that are displayed, and the more severe, the higher the chances are of a social security disability or SSI claim being granted. Generally, anxiety claims are not so severe that disability would be granted. But, anxiety in combination with other disabilities can make for a strong claim.
As with any disability, your chances of being granted increase if you have consistent medical records of your condition. If you have not seen any doctors within a few months of your application, you may be sent to a doctor who will evaluate your condition. It is best to have your own doctor.

In order to be granted Social Security Disability or SSI benefits your arthritis must be affecting you to the point that you will not be able to do any kind of work for at least 12 months. If you are unable to do the work you currently do, consider whether or not you could reasonably do another job. If you still feel like you couldn't, then you may have a good claim. You should be able to show a history of swelling, joint pain, and tenderness in the joints where you have arthritis. You should be able to give a good idea as to the frequency of pain and explain just how painful it is.
Something else they will look for is if you have trouble walking or can't walk without pain, or if you have difficulty with your fine or gross movements or a loss of function. Something else that will be considered is the affect on your organs and other symptoms, such as fatigue, fever, and weight loss.

Social Security Disability for Somatoform Disorders:

In order to be granted Social Security Disability or SSI benefits, the Somatoform Disorders must be affecting the claimant to the point that he or she would not be able to do any kind of work. Consider if there are any jobs that this person could reasonably take on without needing additional help or special treatment from the employer. Medical treatment will be almost essential to any Somatoform Disorders claim for Social Security disability benefits or SSI.
When a disability claim for mental Somatoform Disorders is reviewed, Social Security will want to know if medication has been taken regularly, if there have been disturbances to vision, speech, hearing, use of a limb, movement and its control, or unrealistic interpretation of physical signs or sensations associated with the preoccupation or belief that one has a serious disease or injury, and restriction of activities of daily living, difficulty maintaining social functioning, or dificulty maintaining concentration, persistence, or pace. The more of these symptoms that are displayed, and the more severe, the higher the chances are of a social security disability or SSI claim being granted. Generally, Somatoform Disorders claims are not so severe that disability would be granted. But, Somatoform Disorders in combination with other disabilities can make for a strong claim.
As with any disability, your chances of being granted increase if you have consistent medical records of your condition. If you have not seen any doctors within a few months of your application, you may be sent to a doctor who will evaluate your condition. It is best to have your own doctor.
